Abridged Pathway โ€” ASEAN NRA Reliance

PH-Unique ยท FDA Circular 2022-008 ยท 30 working-day turnaround

Overviewโ€‹

FDA Circular 2022-008 established the Abridged CMDR Pathway โ€” a faster registration route for Class B, C, and D devices that already hold approval from a recognised ASEAN National Regulatory Authority (NRA).

This pathway leverages the technical assessment already conducted by the reference ASEAN NRA, enabling CDRRHR to issue a CMDR within 30 working days of payment receipt rather than the standard CMDR processing timeline.

Eligible Reference NRAsโ€‹

The abridged pathway applies to devices approved by an ASEAN NRA that is recognised by CDRRHR for this purpose. ASEAN NRAs include:

CountryRegulatory Authority
SingaporeHSA (Health Sciences Authority)
MalaysiaMDA (Medical Device Authority)
ThailandThai FDA / MDCD
IndonesiaBPOM
VietnamDAV / Ministry of Health
MyanmarFDA Myanmar
Brunei, Cambodia, LaosRespective national authorities

Confirm the current list of recognised reference ASEAN NRAs with CDRRHR โ€” the list may be updated.

Eligibility Requirementsโ€‹

To use the abridged pathway:

  1. Device holds a current, valid approval from a recognised ASEAN NRA
  2. The device submitted to CDRRHR is technically identical to the reference-approved device:
    • Same intended purpose
    • Same materials and specifications
    • Same design
  3. The applicant declares identical specifications in writing
  4. Payment of applicable fees must be received before the 30-working-day clock starts

30 Working-Day Timelineโ€‹

The 30 working-day turnaround starts from payment receipt (not from submission of the application). Ensure fees are paid promptly after the application is accepted as complete.

Conditions for Withholding Abridged Approvalโ€‹

CDRRHR reserves the right to withhold or escalate beyond 30 working days if:

  • Safety signals or concerns exist regarding the device
  • The reference NRA's review is deemed insufficient for Philippines context
  • The device specifications are found to differ from those approved by the reference NRA
  • Additional information is required for public health protection

Abridged Pathway Documentationโ€‹

The abridged application uses a reduced dossier compared to the standard CMDR:

DocumentRequirement
Reference NRA approval certificateCurrent, valid โ€” identifies device
Identical specifications declarationWritten declaration from Philippines license holder
Abbreviated device descriptionConsistent with reference submission
Letter of Authorization (with notarised declaration)Required
Philippines-compliant labellingPer AO 2018-0002
LTOValid for applicant entity
Fee paymentTriggers the 30-working-day clock

Strategic Valueโ€‹

If your device holds HSA (Singapore), Malaysian MDA, Thai FDA, or another ASEAN NRA approval, the abridged pathway is the recommended first-choice approach for Philippines registration. The 30-working-day timeline is dramatically faster than standard CMDR processing.

Example: A device approved by Singapore HSA (one of the fastest ASEAN markets) can leverage that approval to obtain Philippines CMDR in approximately 6 working weeks after payment.
